The International Criminal Court (ICC) in The Hague cannot proceed with a case against Russian President Vladimir Putin as long as he officially holds the highest state office. Sources familiar with the procedures confirmed that a similar rule applies to Prime Minister Mikhail Mishustin and Foreign Minister Sergey Lavrov.

According to information obtained by journalists, incumbent heads of state are protected by the principle of international immunity, shielding them from criminal prosecution while in office. Although the ICC previously issued an arrest warrant for Vladimir Putin, its execution is only possible once he loses presidential authority.

This means that the Court will not initiate either in-person or in-absentia proceedings until Putin and other senior Russian officials leave office. Sources emphasize that the tribunal is obligated to follow the procedures outlined in the Rome Statute, even amid a complex international situation.

A separate question is the possibility of holding a trial in absentia. Theoretically, the Court can consider a case in the absence of the accused, but only if they no longer hold official state positions. This rule is intended to balance legal standards with international stability.

Nevertheless, the arrest warrants remain valid, and in the event of crossing into countries recognizing the ICC's jurisdiction, an arrest may be initiated. However, countries that have not ratified the Rome Statute are not obligated to enforce the Court's decisions.

Thus, the prospects for prosecuting top Russian officials in the short term remain legally and politically constrained. At the same time, international pressure and the symbolic significance of the warrants play an important role in shaping the broader foreign policy landscape.
